Heatons have successfully secured the approval for a change of use from a residential dwelling to a small-scale home for children through the granting of a Certificate Of Lawfulness of Proposed Use Or Development.

We carried out a careful assessment of Government advice and case law. This led us to conclude that, by virtue of the working arrangements and shift patterns of the carers, a change of use would occur in this case. However, the circumstances of this case and the content of recent case law indicates strongly that, whilst there is a change of use, the change would not be material, as the intensity of the use would not be significantly greater. The applicants were delighted to achieve their desired outcome without the requirement for a Planning Application and associated costs.
